ARTICLE 23 – REMBOURSEMENTS
En cas de retour de produit, nous remboursons dans un délai de 14 jours à compter de la réception du produit par nos soins.

Nous n’acceptons aucun remboursement si le colis est retardé avant 6 semaines, cependant, si le colis est déclaré perdu par le transporteur avant cette date, nous vous rembourserons la commande dans les 14 jours par le mode de paiement utilisé.

Après 6 semaines, le colis sera considéré comme perdu et vous pourrez demander un remboursement.

ARTICLE 24 – ANNULATION
L’annulation des commandes n’est possible que si vous nous avez contactés au plus tard 2 heures après votre commande. En cas d’annulation, nous nous réservons le droit de ne pas rembourser les frais de transaction.

ARTICLE 25- RÉTRACTATION

25.1- Délai légal du droit de rétractation
Conformément aux dispositions légales en vigueur, vous disposez d’un délai de 14 jours à compter de la réception de vos produits pour exercer votre droit de rétractation sans avoir à justifier de motifs ni à payer de pénalité. Après communication de votre décision d’exercer votre droit de rétractation dans ce délai de 14 jours, vous disposez d’un nouveau délai de 14 jours pour retourner le ou les produits concernés par la rétractation.

Le droit de rétractation ne s’applique pas aux clients situés en dehors de l’Union européenne.

25.2 – Délai de rétractation contractuel
Sur couteau-automatique.fr nous vous offrons la possibilité d’exercer votre droit de rétractation dans un délai de 14 jours à compter de la réception des produits. Vous disposez ensuite d’un nouveau délai de 14 jours à compter de la communication de votre décision de rétractation pour nous renvoyer les produits concernés.

En cas de commande contenant plusieurs produits, passée sur couteau-automatique.fr, le délai de 14 jours pour communiquer votre décision de rétractation court à compter de la réception du dernier produit.

Les modalités d’exercice de votre droit de rétractation sont précisées au 24.3.

25.3. Conditions d’exercice du droit de rétractation
En cas d’exercice du droit de rétractation dans le délai visé au 24.2, seul le prix du ou des produits achetés et les frais d’envoi seront remboursés, les frais de retour restant à votre charge.

Les retours sont à effectuer dans leur état d’origine et complets (emballage, accessoires, notice…) permettant leur recommercialisation à l’état neuf, et, si possible, accompagnés d’une copie de la facture d’achat pour une gestion optimale. En cas de dépréciation du produit résultant de manipulations autres que celles nécessaires pour établir la nature, les caractéristiques et le bon fonctionnement du produit, votre responsabilité pourra être engagée.

Pour exercer votre droit de rétractation, conformément aux dispositions légales, vous trouverez ci-dessous, en annexe, le formulaire type de rétractation à nous adresser à l’adresse suivante : . Vous pouvez exercer votre droit de rétractation par tout moyen et notamment par courrier ou e-mail à contact@couteau-automatique.fr en exprimant votre volonté de vous rétracter sans aucune ambiguïté, et en mentionnant la commande concernée par cette rétractation.

Une fois le formulaire de rétractation ou la déclaration de rétractation envoyé à couteau-automatique.fr, au plus tard dans les 14 jours suivant la réception de votre commande, vous devez retourner le ou les produits concernés à l’adresse de couteau-automatique.fr, dans un délai raisonnable et, au plus tard, dans les 14 jours suivant l’envoi du formulaire de rétractation ou de la déclaration.

Conformément au règlement n° 1182/71/ CEE du Conseil du 3 juin 1971 portant détermination des règles applicables aux délais, aux dates et aux termes :
1° Le jour de la conclusion du contrat ou celui de la réception du bien n’est pas compté dans le délai mentionné à l’article L. 221-18 ;
2° Le délai commence à courir au début de la première heure du premier jour et se termine à la fin de la dernière heure du dernier jour du délai ;
3° Si ce délai expire un samedi, un dimanche ou un jour férié, il est prolongé jusqu’au premier jour ouvrable suivant.

Lorsque les informations relatives au droit de rétractation n’ont pas été fournies au consommateur dans les conditions prévues au 2° de l’article L. 221-5, le délai de rétractation est prolongé de douze mois à compter de l’expiration du délai de rétractation initial, déterminé conformément à l’article L. 221-18.
Toutefois, lorsque la fourniture de cette information intervient pendant cette prolongation, le délai de rétractation expire à l’issue d’une période de quatorze jours à compter du jour où le consommateur a reçu cette information.

La charge de la preuve de l’exercice du droit de rétractation dans les conditions prévues à l’article L. 221-21 incombe au consommateur.

25.6 – Refus du colis
Dans le cas d’un refus, les frais de retour seront à votre charge et automatiquement déduits de votre remboursement même si les frais de port initiaux ont été offerts.

Si votre refus est dû à une anomalie constatée sur l’emballage ou sur votre produit.
Dans ce cas, couteau-automatique.fr prendra en charge les frais de retour. Pour plus d’informations sur le traitement de votre SAV, nous vous invitons à nous contacter à contact@couteau-automatique.fr.

25.6 – Remboursements
En cas d’exercice du droit de rétractation, couteau-automatique.fr procédera au remboursement des sommes versées (y compris les frais de livraison) au plus tard dans les 14 jours suivant la date à laquelle couteau-automatique.fr est informé de votre décision de vous rétracter et selon le même moyen de paiement que celui utilisé pour la commande (sauf accord exprès de votre part pour un remboursement selon un autre moyen de paiement). Cette date de remboursement peut être différée jusqu’à récupération du produit ou jusqu’à ce que vous ayez fourni une preuve de l’expédition du produit, la date retenue étant le premier de ces faits. couteau-automatique.fr n’est pas tenu de vous rembourser les frais supplémentaires si vous avez expressément choisi un mode de livraison plus coûteux que le mode standard proposé sur couteau-automatique.fr.

couteau-automatique.fr n’est pas tenu de vous rembourser les frais de douane encourus lors de la rétractation. Pour obtenir le remboursement ou la remise des droits, vous devez déposer une demande auprès du bureau de douane ou du service qui a notifié la dette.

Il est toutefois précisé, dans l’hypothèse d’un paiement total ou partiel par chèques cadeaux, que ceux-ci ne peuvent être remboursés ni en espèces, ni par chèque, ni par carte bancaire. Le remboursement des achats effectués avec des chèques cadeaux se fera exclusivement sous forme de chèques cadeaux d’un montant identique à celui payé sous cette forme.
